Expert Report Supports Defendant in Contractor Dispute Over Poor Renovation Work

 

DRS were appointed by the Defendant’s solicitors to provide an Expert Witness Report in connection with a dispute over a full house renovation, including the construction of a new porch. The Defendant had withheld payment from the Claimant (the Contractor), citing concerns over the standard and timeliness of the work delivered.

The key questions DRS were instructed to address in the report included:

  1. Whether the services had been carried out with reasonable care and skill, and within a reasonable timeframe.

  2. The extent of any defective or incomplete works.

  3. The estimated cost of rectifying the defects and completing the outstanding works.

  4. What would constitute a reasonable price for the services actually provided.

Drawing on their expert construction knowledge, DRS conducted a thorough site inspection. This included:

  • A full measurement of the property.

  • Comprehensive documentation of defects and unfinished work.

  • Valuation of completed work using standardised industry rates.

  • A detailed cost estimate for all necessary remedial works.

The findings of the report concluded that the Contractor had failed to carry out the renovation with reasonable care, skill, or within a reasonable period. The analysis supported the Defendant’s position that the quality and progress of the works did not justify the charges presented by the Contractor.

The Expert Report provided essential evidence in the legal proceedings, helping to establish the basis for the Defendant’s refusal to pay the disputed invoice.
